SENATOR HUFFMAN VOICES SUPPORT FOR SECOND AMENDMENT RIGHTS

AUSTIN — (November 24, 2009) – Senator Joan Huffman has joined several state officials and leaders from around the country in signing an amicus curiae, or "friend of the court," in the case of McDonald v. City of Chicago.

Last year, in the landmark ruling of District of Columbia v. Heller, the Court reversed D.C.'s ban on handguns, upholding the fundamental right of an individual to keep and bear arms. The verdict, however, applied uniquely to federal enclaves, such as Washington, D.C. The City of Chicago is now challenging the decision, arguing that the law does not apply to bans imposed by state and local governments.

"The right to legal gun ownership is a fundamental liberty that should be upheld at every level of government," Senator Huffman said. "In this next challenge, I am hopeful the Supreme Court will once again defend the Second Amendment right to bear arms as provided by our Constitution."

The Supreme Court agreed to consider the McDonald case this past September. It is expected to come before the Court in February of 2010.
